1. Acceptance of Terms
By accessing or using VinoGuide ("VinoGuide", "the Platform", "we", "us" or "our"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use the Platform.
By using VinoGuide, you acknowledge that you have read, understood and agreed to these Terms.
2. Use of the Platform
VinoGuide is intended for users who are 18 years of age or older. By using the Platform, you confirm that you are of legal drinking age in your jurisdiction.
You agree to use VinoGuide only for lawful purposes and in accordance with these Terms.
VinoGuide is a digital discovery and planning platform designed to help users discover wine estates, tasting rooms, restaurants, wine bars, accommodation and other experiences, and to assist users in planning their visits.
3. User Accounts
Where account registration is required, you are responsible for maintaining the confidentiality of your account credentials and for all activity carried out through your account.
You agree to notify VinoGuide promptly if you become aware of any unauthorised access or use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms or are otherwise used improperly.
4. Venue and Listing Information
VinoGuide provides information about wine estates, tasting rooms, restaurants, wine bars, accommodation providers and other venues and experiences.
We make reasonable efforts to provide useful and accurate information. However, venue information may change and VinoGuide cannot guarantee that all information displayed on the Platform is complete, accurate, current or error-free at all times.
Information including, but not limited to: opening hours, tasting prices, food and beverage prices, menus, availability, contact details, location and directions, services and experiences, events, facilities, policies, ratings and reviews, and other venue information, may change without notice.
Users should always confirm important information directly with the venue before travelling or making a booking.
VinoGuide is not responsible for losses, inconvenience or disappointment arising from inaccurate, outdated or changed venue information.
5. VinoGuide Verified Venues
Some venues displayed on VinoGuide may display a "VinoGuide Verified" badge.
A VinoGuide Verified badge indicates that VinoGuide has undertaken a verification or confirmation process in relation to certain information associated with that venue at the time of verification.
Verification does not constitute an endorsement, guarantee or warranty by VinoGuide regarding the venue, its services, quality, safety, pricing, availability or future operations.
A venue that does not display a VinoGuide Verified badge has not necessarily been independently verified by VinoGuide.
Information relating to unverified venues may have been obtained from publicly available sources, venue websites, social media, third-party sources or other available information. Such information may be incomplete, outdated or inaccurate.
The absence of a VinoGuide Verified badge should therefore be understood to mean that the relevant venue information has not been independently verified by VinoGuide at the time it is displayed.
Users are encouraged to contact the venue directly to confirm important details before relying on information displayed on VinoGuide.
VinoGuide may add, remove or change a venue's verification status at any time.
6. Bookings and Availability
VinoGuide may provide links, booking enquiries, booking functionality or other tools that allow users to contact or make arrangements with venues or accommodation providers.
Unless expressly stated otherwise, VinoGuide is not a party to any booking, reservation, purchase or other agreement between a user and a venue or service provider.
Bookings, reservations, cancellations, payments, refunds and the provision of services are the responsibility of the relevant venue or service provider and are subject to that provider's own terms and conditions.
Where VinoGuide displays availability or booking information, such information may change and is not guaranteed unless a booking has been successfully confirmed by the relevant provider.
VinoGuide is not responsible for a venue's failure to honour a booking, reservation, advertised price, availability or service.
7. Third-Party Websites and Services
VinoGuide may contain links to third-party websites, booking platforms, maps, payment providers, social media platforms and other external services.
These third-party services are operated independently from VinoGuide. We do not control and are not responsible for their content, availability, security, policies, products, services or transactions.
Your use of third-party services is subject to the terms and policies of those third parties.
8. User-Generated Content
Where VinoGuide allows users to submit reviews, ratings, comments, photographs or other content, you are responsible for ensuring that your content is accurate, lawful and does not infringe the rights of another person or organisation.
You must not submit content that is fraudulent, defamatory, misleading, abusive, discriminatory, unlawful or otherwise inappropriate.
VinoGuide reserves the right to remove or restrict content that we reasonably believe violates these Terms or our platform standards.
9. Intellectual Property
All VinoGuide content, including but not limited to text, graphics, logos, branding, interface design, photographs, databases, software and other materials created or owned by VinoGuide, is protected by applicable intellectual property laws.
You may access and use the Platform for personal, non-commercial purposes.
You may not reproduce, copy, modify, distribute, sell, publish, scrape, exploit or commercially use VinoGuide content without our prior written permission, except where permitted by applicable law.
Third-party trademarks, logos, photographs and other materials displayed on VinoGuide remain the property of their respective owners.
10. Disclaimer of Warranties
The Platform and its content are provided on an "as is" and "as available" basis to the fullest extent permitted by law.
VinoGuide does not warrant that: the Platform will always be available or uninterrupted; information will always be accurate, complete or current; venue information will remain unchanged; prices or availability displayed will remain valid; a venue will provide the services or experiences described; a booking or reservation will be available or honoured; or the Platform will be free from errors, viruses or other harmful components.
VinoGuide provides information to assist users with discovery and planning. Users remain responsible for independently confirming information directly with venues before making decisions, travelling or spending money.
11. Limitation of Liability
To the fullest extent permitted by the laws of the Republic of South Africa, VinoGuide and its owners, employees, contractors, partners and service providers shall not be liable for any indirect, incidental, special, consequential or economic loss arising from or relating to: your use of or inability to use the Platform; your reliance on information displayed on the Platform; incorrect, incomplete or outdated venue information; changes to opening hours, prices, menus or availability; venue closures or changes in operations; cancellations or unsuccessful bookings; the acts or omissions of venues or third-party service providers; or your transactions or interactions with venues.
Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under South African law.
12. No Endorsement or Guarantee
The inclusion of a venue, business, accommodation provider, restaurant, wine estate, tasting room, wine bar or experience on VinoGuide does not necessarily constitute an endorsement, recommendation, guarantee or representation by VinoGuide.
Likewise, a VinoGuide Verified badge should not be interpreted as a guarantee of the quality, safety, suitability, legality, pricing or availability of a venue or its services.
Users should exercise their own judgement and conduct any additional checks they consider necessary.
13. Changes to the Platform
VinoGuide may add, remove, modify or discontinue features, venues, listings, content or services on the Platform at any time without prior notice.
We do not guarantee that any particular venue, feature or service will remain available.
14. Changes to These Terms
We reserve the right to modify these Terms from time to time.
Any updated Terms will be published on the Platform with a revised "Last updated" date. Your continued use of VinoGuide after the updated Terms have been published constitutes acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
Subject to any mandatory provisions of applicable law, disputes arising from or relating to these Terms or your use of VinoGuide shall be subject to the jurisdiction of the courts of South Africa.
